DMCA Policy

At MLB.com, we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted a policy of responding to notices of alleged infringement that are properly provided to us. This policy describes the information that should be present in a DMCA notice and a counter-notice.

It is our policy to expeditiously remove content that infringes the copyright rights of others and to terminate the accounts of repeat infringers. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via MLB.com, please follow the procedures outlined below.

Filing a DMCA Notice of Alleged Infringement

If you are a copyright owner or an agent thereof and believe that any content hosted on MLB.com infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):

  1. An electronic or physical signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit us to locate the material (e.g., a specific URL where the material is located);
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under 17 U.S.C. 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

The above information must be submitted to our Designated DMCA Agent using the contact method provided in the 'Contact Us' section below, specifying 'DMCA Notice' as the subject.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled, you may file a counter-notification with us. For your counter-notification to be valid under the DMCA, you must provide our Designated Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):

  • An electronic or physical signature of the subscriber;
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL where the material was located);
  • A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
  • The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which MLB.com may be found, and that the subscriber will accept service of process from the person who provided the original DMCA notification or an agent of such person.
